Welcome to esence.io. These Terms of Service ("Terms") govern your access to and use of the website and fractional technical advisory services provided by Esence Private Limited ("Company," "we," "us," or "our"), a company registered in Bangalore, India (CIN: U62099KA2025PTC212992).

By accessing our website, reading our content, or utilizing our forms, you agree to be bound by these Terms. If you do not agree, please discontinue use immediately.

1. Scope of Services & Informational Disclaimer

Esence Private Limited provides high-level technical consultancy, including but not limited to Fractional CTO services, architectural audits, scalability roadmaps, and platform engineering advisory.

All technical articles, architectural blueprints, configuration blocks including but not limited to Nx, Turborepo, Devbox, Go Task, or CI pipelines), and guides published on this platform are provided strictly for educational and informational purposes. They are provided on an "as-is" baseline without warranties of any kind. Implementing these configurations in your own local or production environments is done entirely at your own risk.

2. Intellectual Property & Anti-Scraping Mandate

  • Proprietary Assets: All text, design system configurations, technical articles, software code examples, and custom interactive SVG diagrams displayed on esence.io are the exclusive intellectual property of Esence Private Limited.

  • Scraping & Extraction Bans: You are strictly prohibited from utilizing automated tools, web crawlers, scrapers, data-mining scripts, or bulk data harvesters to systematically extract our engineering blog posts, text assets, or interactive graphic code blocks for the purpose of commercial software cloning or offline foundational AI model training without our express, prior written authorization.

  • Permitted Search & GEO Indexing: This restriction does not apply to public search engine crawlers or generative AI search agents (including but not limited to Googlebot, OAI-SearchBot, and PerplexityBot) accessing the platform strictly to index content for real-time public search results, conversational user summaries, and direct source citations back to esence.io.

3. Acceptable Use & Booking Terminal Protection

When interacting with our infrastructure—including contact modules, text submission terminals, and discovery booking forms—you explicitly agree not to:

  • Submit false, malicious, fraudulent, or intentionally misleading information.

  • Use automated scripts, spam bots, or software payloads to flood, disrupt, or manipulate our scheduling systems.

  • Attempt to inject malicious scripts, execute cross-site scripting (XSS), or disrupt the server infrastructure running esence.io.

We reserve the absolute right to blacklist IP subnets or terminate access for any user found violating these structural boundaries.

4. Limitation of Liability

To the maximum extent permitted by applicable law, Esence Private Limited, its directors, and its engineers shall not be liable for any indirect, incidental, special, consequential, or punitive damages. This includes, without limitatio , loss of startup profits, data loss, repository corruption, production system downtime, or financial runway depletion arising out of your utilization of our website resources, tutorials, or open-source scripts.

In no event shall our total aggregate liability for any direct claims exceed the actual financial fees paid by you to Esence Private Limited for the specific professional service rendered.

5. Separate Professional Service Agreements

These public website Terms solely govern your casual browsing use of esence.io. Any formal engagement for professional advisory services, Fractional CTO retainers, or architectural audits between you and Esence Private Limited will be strictly governed by a separate, mutually executed Master Service Agreement (MSA) and Statement of Work (SOW).

In the event of any operational conflict between these website Terms and a signed corporate MSA, the provisions of the signed corporate MSA shall entirely supersede and control the engagement.

6. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India. Any legal actions, disputes, or proceedings arising out of or related to these Terms shall be subject to the exclusive jurisdiction of the courts located in Bangalore, Karnataka, India.
